By accessing or using PulseGuardian's website at pulseguardian.com or our mobile application (collectively, the "Service"), you confirm that you are at least 16 years of age, have read and understood these Terms of Service, and agree to be bound by them.

If you are using our Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, please do not access or use our Service.

2. Description of Service

PulseGuardian LLC ("PulseGuardian," "we," "our," or "us") provides an AI-powered health and wellness monitoring platform that includes:

• Personal health vitals tracking and trend analysis
• AI-generated weekly health insight reports
• Sleep quality analysis and scoring
• Stress monitoring and anomaly detection alerts
• Medication and supplement reminders
• Family and team health dashboards
• White-label PDF report generation (Business plan)
• API access for third-party integrations (Business plan)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to users.

3. User Accounts

To use PulseGuardian, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date information during registration
• Maintain the security of your password and account credentials
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activity that occurs under your account
• Not share your account credentials with any third party
• Not create more than one account per person

4. Subscription & Billing

PulseGuardian offers the following subscription plans, billed monthly in Euros (EUR):

By subscribing, you authorize PulseGuardian to charge your payment method on a recurring monthly basis. Subscriptions automatically renew unless cancelled before the next billing date.

• All payments are processed securely by Stripe
• Prices are listed in Euros (EUR) and may vary by region
• You may upgrade or downgrade your plan at any time
• Upgrades take effect immediately; downgrades take effect at next billing cycle
• We reserve the right to change pricing with 30 days advance notice

5. Refund Policy

• 14-day guarantee: Full refund available within 14 days of first subscription
• After 14 days: Payments are non-refundable
• Cancellation: You may cancel at any time — access continues until end of billing period
• Partial refunds: Not available for unused portions of a billing period
• Fraudulent charges: Contact us immediately at support@pulseguardian.com

To request a refund, email support@pulseguardian.com with your account email and reason for the refund request.

6. Acceptable Use

You agree not to use PulseGuardian to:

• Violate any applicable laws or regulations
• Upload false, misleading, or inaccurate health data
• Attempt to gain unauthorized access to our systems or other accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scrapers to access the Service
• Resell or commercially exploit the Service without written permission
• Transmit any malware, viruses, or harmful code
• Harass, abuse, or harm other users of the platform
• Use the Service for any unlawful or fraudulent purpose

7. Health Disclaimer

The health insights, reports, and alerts provided by PulseGuardian are for informational and wellness purposes only. They are not intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Be used as the sole basis for any medical decision

PulseGuardian LLC shall not be liable for any health outcomes resulting from reliance on information provided by our Service. In case of a medical emergency, contact emergency services immediately.

8. Intellectual Property

All content, features, and functionality of PulseGuardian — including but not limited to text, graphics, logos, icons, images, software, and AI models — are the exclusive property of PulseGuardian LLC and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all health data you enter into the platform. By using our Service, you grant PulseGuardian a limited license to process your data solely for the purpose of providing the Service to you.

You may not reproduce, distribute, modify, or create derivative works of any part of our Service without express written permission from PulseGuardian LLC.

9. Privacy

Your use of PulseGuardian is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Termination

Either party may terminate this agreement at any time:

• By you: Cancel your subscription at any time from your account settings
• By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice

Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days after termination before being permanently deleted, unless you request earlier deletion.

11. Limitation of Liability

To the maximum extent permitted by applicable law, PulseGuardian LLC shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, goodwill, or business opportunities
• Damages resulting from unauthorized access to your account
• Damages resulting from reliance on health information provided by our Service
• Service interruptions, errors, or technical failures

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to PulseGuardian in the 3 months preceding the claim.

12. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service, we encourage you to first contact us at legal@pulseguardian.com to seek an informal resolution.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes that cannot be resolved informally shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association.

For users in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws.

13. Changes to Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you by:

• Sending an email notification to your registered email address
• Displaying a prominent notice on our website or within the app
• Updating the "Last Updated" date at the top of this page
